1. Introduction and Initial Note on the Fair Credit Reporting Act and Related Obligations

These Terms and Conditions (collectively, the “Terms”), together with our Privacy Policy, form a legally binding agreement between you (“You” or “Your”) and PeopleFinder.Info (“PeopleFinder.Info,” “We,” “Our,” or “Us”).

PeopleFinder.Info provides a platform that aggregates publicly available information sources for your convenience. This service is intended strictly for personal use, not for professional purposes, and allows users to search for information as permitted under these Terms. Examples of acceptable uses include accessing information from one’s own public records, reconnecting with friends or family, or learning about neighbors, online acquaintances, or people involved in personal transactions. Visitors to our Site can view and/or access content, information, media, text, data, images, graphics, user interfaces, audio, video, photographs, trademarks, logos, artwork, designs, digital conversions, products, services, software functionality, and other materials (collectively, “Content”) provided by PeopleFinder.Info and our third-party content providers (“Third-Party Providers”). This includes data from various external websites or services that compile information on individuals (each, a “Search Subject”) and make it available through the Site or through other services offered (“PeopleFinder Queries”).

PEOPLEFINDER.INFO DOES NOT PROVIDE PRIVATE INVESTIGATIVE SERVICES AND IS NOT A CONSUMER REPORTING AGENCY AS DEFINED BY THE FAIR CREDIT REPORTING ACT (FCRA), 15 U.S.C. § 1681 et seq. THE INFORMATION WE PROVIDE IS NOT INTENDED, IN WHOLE OR IN PART, TO BE USED IN DETERMINING A PERSON’S ELIGIBILITY FOR (a) CREDIT OR INSURANCE FOR PERSONAL, FAMILY, OR HOUSEHOLD PURPOSES; (b) EMPLOYMENT PURPOSES; (c) HOUSING, EDUCATION, OR OTHER BENEFITS; OR (d) ANY BUSINESS TRANSACTION INITIATED BY AN INDIVIDUAL CONSUMER FOR PERSONAL, FAMILY, OR HOUSEHOLD USE. WE DO NOT MAKE ANY WARRANTIES OR REPRESENTATIONS CONCERNING THE CREDIT WORTHINESS, CHARACTER, GENERAL REPUTATION, PERSONAL CHARACTERISTICS, OR LIFESTYLE OF ANY INDIVIDUAL. THEREFORE, THE ADDITIONAL PROTECTIONS AND OBLIGATIONS THAT APPLY TO CONSUMER REPORTING AGENCIES UNDER THE FCRA ARE NOT RELEVANT TO THESE TERMS.

You therefore acknowledge and agree that you will not use PeopleFinder Queries, nor access or use any Content or information from the Site about a Search Subject or individual, for any purpose prohibited by the FCRA. As we are NOT a Consumer Reporting Agency, you are prohibited under the FCRA from using any information obtained from the Site for the purpose of determining a Search Subject’s eligibility for:

• Employment decisions, including hiring, reassignment, promotion, or retention of an individual (including household workers like babysitters, cleaning personnel, contractors, etc.);
• Housing decisions, including leasing residential or commercial property to a Search Subject;
• Education or Benefits, including assessing qualifications for educational programs or scholarships;
• Credit, Loans, or Insurance, including evaluating risk associated with credit, loans, or insurance based on current debt obligations; and/or
• Personal Business Transactions, including determining whether a Search Subject complies with the terms of an individual customer account.

Additionally, using any Content from our Site to take “adverse action,” as defined by the FCRA, is prohibited. Using information from PeopleFinder.Info in these ways breaches these Terms and can result in potential legal consequences. We reserve the right to terminate user access, close Accounts, and report violations to relevant authorities. If you are unsure whether your intended use of information from PeopleFinder.Info complies with these restrictions, please reach out to us at [email protected] before conducting any PeopleFinder Queries or accessing information on a Search Subject from our Site.

2. Scope of These Terms, License Grant, Electronic Signature, and Legal Age Requirement

We retain the right, at our discretion and without prior notice, to restrict your access to the Site or any portion of it and to terminate your rights under these Terms. Your rights under these Terms will automatically terminate if you fail to comply with them. Termination will be effective immediately, without further notice, and you are then required to destroy any copies of any aspect of the Site in your possession, custody, or control.

These Terms govern your use and access of the Content provided and made available by us, your purchase of membership plans through the Site, and your use of any PeopleFinder Queries provided in relation to these. PEOPLEFINDER.INFO GRANTS YOU A NON-EXCLUSIVE, NON-TRANSFERABLE (meaning your account is for your use alone; family, friends, or colleagues must obtain their own accounts), REVOCABLE, AND LIMITED LICENSE FOR PERSONAL, INDIVIDUAL USE ONLY (NOT FOR PROFESSIONAL PURPOSES). THIS LICENSE TO ACCESS AND USE THE SITE, CONTENT, AND PEOPLEFINDER QUERIES (and, for subscribers, additional related services) IS GRANTED ON THE CONDITION THAT YOU ACCEPT AND AGREE TO ALL TERMS CONTAINED HEREIN. You also agree that PeopleFinder.Info may terminate this license at any time, for any reason. BY USING THE SITE, YOU ACKNOWLEDGE AND ACCEPT THESE TERMS IN FULL. BY MAKING A PURCHASE, SELECTING A PAYMENT METHOD, AND PROVIDING YOUR PAYMENT INFORMATION, YOU AUTHORIZE US TO CHARGE YOUR SELECTED PAYMENT METHOD FOR THE CHOSEN MEMBERSHIP PLAN. IF YOU DO NOT AGREE WITH ALL TERMS, YOU ARE NOT PERMITTED TO ACCESS OR USE THE SITE AND ARE ADVISED TO EXIT IMMEDIATELY.

Accordingly, these Terms apply to you when you: (a) access, view, download, or otherwise use any part of the Site, except the home page located at www.peoplefinder.info; and/or (b) submit an online application to become a user or subscriber on PeopleFinder.Info, which enables access to various services provided through the Site. By performing either of these actions, you confirm that you (a) have read, understood, and agreed to be bound by these Terms in their entirety; (b) consent to the use of electronic signatures, contracts, orders, and records and to the electronic delivery of notices, policies, and transaction records initiated or completed through the Site or other interactions with PeopleFinder.Info; and (c) waive any rights or requirements under any laws or regulations in any jurisdiction that require (i) an original (non-electronic) signature, (ii) the delivery or retention of non-electronic records, or (iii) non-electronic payments or credits.

By providing your email address, you consent to receive emails from us. Access to the Site and its services is restricted to individuals at least eighteen (18) years of age who are legally able to enter into binding contracts under applicable law. If you are under eighteen (18) or do not agree to these Terms in full, you are not permitted to access, view, download, or use any page on the Site other than the home page located at www.peoplefinder.info and should not submit an online application to become a user or subscriber.

The PeopleFinder.Info Privacy Policy (“Privacy Policy”) is incorporated by reference into these Terms. By accepting these Terms, you acknowledge and consent to the collection and use of certain personally identifiable information as outlined in the Privacy Policy. Any requests to remove your information from PeopleFinder.Info’s People Search results will be managed according to the Privacy Policy, which can be viewed [here].

3. Class Action Waiver, Mandatory Arbitration, Dispute Resolution, and Governing Law

BY USING THE SITE, YOU AGREE TO THE MANDATORY INDIVIDUAL ARBITRATION PROVISION TO RESOLVE DISPUTES, REPLACING JURY TRIALS OR CLASS ACTIONS AND LIMITING AVAILABLE REMEDIES. You further acknowledge that any claims, disputes, or controversies between you and PeopleFinder.Info (including claims against any of our employees, agents, affiliates, subsidiaries, predecessors, successors, or assigns) related to the Site, its Content, PeopleFinder Queries, related services, transactions, relationships, or your information—including but not limited to tort and contract claims, claims under any federal, state, or local statute, law, order, ordinance, or regulation, and questions of arbitrability—will be resolved through final and binding arbitration as outlined below. You agree that all such claims shall be brought solely on an individual basis and not as part of any class, representative, or private attorney general proceeding. Similarly, you accept that any disagreement regarding whether a dispute is subject to arbitration will be resolved by the arbitrator, not a court. Additionally, the arbitrator may not consolidate claims from different individuals or preside over any form of a collective proceeding. By agreeing to arbitration, you voluntarily waive any right to a jury trial.

AGREEING TO THIS ARBITRATION AGREEMENT MEANS YOU ARE WAIVING YOUR RIGHTS TO GO TO COURT OR HAVE A JURY TRIAL. Arbitration allows disputes to be resolved by neutral arbitrators rather than a judge or jury. Although arbitration is less formal than a court trial, an arbitrator may still grant relief.

Apart from the arbitration agreement stated above, you also waive any right to participate in any class action in any way related to or arising from these Terms. This class action waiver is essential to the arbitration of any dispute(s) and is inseparable from this agreement.

YOU UNDERSTAND THAT BY ACCEPTING THIS AGREEMENT TO ARBITRATE, WHICH INCLUDES A WAIVER OF CLASS ACTION AND CLASS ARBITRATION, YOU MAY ONLY PURSUE CLAIMS AGAINST PEOPLEFINDER.INFO, OUR AGENTS, OFFICERS, SHAREHOLDERS, EMPLOYEES, AFFILIATES, PREDECESSORS, SUCCESSORS, OR ASSIGNS INDIVIDUALLY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION. IF YOU DO NOT AGREE TO THIS ARBITRATION AGREEMENT AND CLASS ACTION WAIVER, PLEASE NOTIFY US IN WRITING AND DO NOT USE THE SITE, PEOPLEFINDER QUERIES, OR OUR SERVICES.

These Terms shall be considered executed and performed in New York, NY, and are governed by and interpreted in accordance with New York State laws, without regard to conflicts of law principles.

At PeopleFinder.Info, we aim to resolve most issues through our customer service team. Should you have a concern, please reach out as directed in the “How to Contact Us” section. If your concern remains unresolved, we outline the following resolution process for disputes arising from your use of the Site or services provided (each a “Service Claim”).

To reach an efficient resolution, you and PeopleFinder.Info agree to first discuss any Service Claim informally for a minimum of 30 days. The party raising the Service Claim must send a notice detailing (1) the nature of the claim and (2) a proposed resolution. If you wish to raise a Service Claim, please send your notice by email ([email protected]) or certified mail to: PeopleFinder.Info, Attn: Legal Department, MSC – 149098, P.O. Box 105168, Atlanta, GA 30348-5168. We will contact you at the email or mailing address provided in your notice. If PeopleFinder.Info initiates a Service Claim, we will send notice to the email we have on file for you, or by other legal means if necessary.

IF A RESOLUTION IS NOT REACHED WITHIN 30 DAYS, BOTH PARTIES AGREE TO BINDING INDIVIDUAL (NOT CLASS) ARBITRATION ADMINISTERED BY ARBITRATION RESOLUTION SERVICES INC. (“ARS”) UNDER RULES GOVERNING DISPUTES BETWEEN BUSINESSES AND INDIVIDUALS. If ARS is unavailable or declines to arbitrate, arbitration will be managed by a widely recognized arbitration organization that both parties mutually consent to, without unreasonable delay or refusal.

Exceptions to Arbitration: Both parties may pursue intellectual property claims or claims regarding unauthorized data access on the Site (including claims relating to patent, copyright, trademark, service mark, trade secrets, or automated data scraping) in New York’s state or federal courts. Both parties agree to submit to these courts’ jurisdiction.

Nothing in these Terms precludes either party from seeking injunctive relief in New York courts to protect rights pending an arbitration outcome. To resolve issues promptly, both parties agree to initiate arbitration or court proceedings, where allowed, within one year of the claim’s arising and waive any right to a jury trial; otherwise, the claim is waived.

Rather than requiring physical presence in New York, ARS provides cloud-based arbitration. Any disagreements over arbitration location will be settled by an ARS arbitrator.

After the 30-day informal resolution period, you may initiate individual (not class) arbitration per ARS’s rules. If you initiate arbitration, your fees will be limited to the Application filing fee specified by ARS. Both parties agree that any arbitration outcome may be enforced by a court of competent jurisdiction. If PeopleFinder.Info loses, we will reimburse your reasonable legal fees; however, if we prevail, we will not seek recovery of our legal fees, irrespective of who initiated arbitration.

Class Action and Trial Waiver: UNDER THESE TERMS, YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION AGAINST US. ANY AWARD OR DECISION BY THE ARBITRATOR WILL BE FINAL AND BINDING, ENTERABLE AS JUDGMENT IN ANY COMPETENT COURT.

4. Removing Your Information

If you wish to have your personal information removed from our Site, please visit our Opt-out page.

5. Modifications to These Terms

We reserve the right to modify these Terms, in whole or in part, at our sole discretion. Any modifications take effect immediately upon being posted to the Site. If you are a subscriber, we may also communicate these changes to you directly when you log in. Please note: (i) changes to the Dispute Resolution section will not apply to any disputes initiated before the modification; and (ii) modifications to the Membership Requirements and Conditions, including Registration, Account Username and Password, Term/Termination, and Fees, Taxes, and Billing, will not affect any charges incurred prior to the modification.

If you do not terminate your account within seven (7) days after we provide notice of modifications as described above, or if you continue to access or use the Site or its services after the modified Terms are posted, you agree to be bound by these changes. Unless otherwise noted, any future offer(s) available on the Site that add to or improve existing features will also be subject to these Terms.

6. Restrictions on Your Use of the Site and Information Obtained from PeopleFinder.Info — Your Obligations

You are granted a non-exclusive, non-transferable, revocable limited license to access and use the Site, Content, PeopleFinder Queries, and, if you are a subscriber, certain other services in accordance with these Terms for individual, personal (not professional) use. PeopleFinder.Info reserves the right to terminate this license at any time, particularly if you fail to comply with the permissible uses of the Site as outlined below.

As a condition to access the Site and its services, you agree that, unless expressly authorized by these Terms or in writing by PeopleFinder.Info, you will not:

1. Conduct any PeopleFinder Queries or otherwise obtain or use any Content or information from the Site about a Search Subject for purposes prohibited by the Fair Credit Reporting Act (FCRA):

   Because PeopleFinder.Info is not a Consumer Reporting Agency, you are prohibited by the FCRA from using information from the Site as a factor in determining a Search Subject’s eligibility for:

   • Employment, including evaluating a Search Subject for hiring, reassignment, promotion, or retention (e.g., household employees such as babysitters, cleaners, or contractors);
   • Tenancy, including deciding whether to lease residential or commercial property to a Search Subject;
   • Educational Admission or Benefits, including assessing a Search Subject’s qualifications for educational programs or scholarships;
   • Personal Credit, Loans, or Insurance, including assessing credit risk based on a Search Subject’s debt obligations;
   • Personal Business Transactions, including evaluating whether a Search Subject continues to meet terms of a customer account;
   • Adoption or Custodianship, including for pet adoption, foster programs, or any related activities;
   • Non-Profit or Charitable Programs, including consideration for any non-profit or charitable organization participation.

   Using information from PeopleFinder.Info for these purposes violates both these Terms and the law, potentially resulting in criminal penalties. We take violations seriously and may terminate access, close accounts, and report violators to authorities. 2. Use the Site, its services, or Content (including PeopleFinder Queries) in violation of applicable laws or for any of the following purposes:

   • Identity Theft, Fraud, or Harassment, including mass marketing, robo-dialing, or spamming other users;
   • Seeking Information on Minors, Celebrities, or Public Figures;
   • Producing, Publishing, or Distributing Defamatory, Obscene, or Offensive Content;
   • Infringing Legal Rights of third parties, including intellectual property and privacy rights;
   • Any Activity that involves false or misleading information, invades privacy, or promotes bigotry or harm.
3. Share or transmit Site Content or PeopleFinder Query results to third parties. Treat all information obtained through the Site as confidential, and take reasonable steps to ensure secure storage.
4. Submit Information or conduct Queries about Search Subjects without proper authorization.
5. Reproduce, compile, or include any part of the Site, Content, or PeopleFinder Queries in any separate database, collection, or information system.
6. Use, copy, reproduce, or distribute any part of the Site or its Content for commercial or competitive purposes.
7. Access the Site through automated means, for mass marketing, direct mail, or tampering purposes.
8. Perform automated activities on the Site, such as using bots, scripts, scrapers, or crawlers.
9. Create Derivative Works by modifying any part of the Site, Content, PeopleFinder Queries, or services.
10. Combine Site Content with Third-Party Content in any form.
11. Interfere with Site functionality or security, including attempting to bypass security measures or accessing non-public areas.
12. Take actions that impose unreasonable demands on Site infrastructure, including excessive report requests.
13. Conceal your computer’s identity or IP address, such as by using a VPN, to disguise communication origins.
14. Deep-link to any PeopleFinder.Info page other than the home page.
15. Cover or obscure advertisements on PeopleFinder.Info.
16. Imitate PeopleFinder.Info’s appearance on another website through framing or mirroring.
17. Use the Site through multiple sessions concurrently, share your account, or grant unauthorized access to others.
18. Use the Site for unsolicited contact or spam purposes.
19. Use the Site, Content, or PeopleFinder Queries for professional, commercial, governmental, marketing, or other non-personal purposes.
20. Access the Site from, or seek information on, individuals outside the United States.

Unauthorized use of the Site may result in civil or criminal prosecution, including penalties under the Computer Fraud and Abuse Act of 1986. We reserve the right to monitor and record Site activity without notice, disclosing information to law enforcement as needed. We may also modify, suspend, terminate, or limit access to the Site or portions thereof at any time without advance notice.

7. Some of Our Reserved Rights

We provide access to the Site as it is available, under the conditions outlined in these Terms. You are solely responsible for your use of the Site and any information you obtain from it. PeopleFinder.Info reserves the following rights:

• To monitor, view, record, review, audit, or otherwise oversee your or others’ use of the Site, PeopleFinder Queries, other services, or information submitted during the application process (“Registration Data”).
• To moderate any disputes between you and third parties, including, but not limited to, disputes with other Site visitors, subscribers, or Search Subjects.
• To verify the identity of any Site user, including any subscriber applicant, and to confirm the purposes for which they are using the Site.
• To reject, cancel, or not accept any orders, or terminate accounts that we reasonably suspect, at our sole discretion, to be fraudulent, related to fraudulent activity, or in violation of these Terms. We also reserve the right to deny subsequent orders from customers with a history of fraudulent orders, previous credit card disputes, or other suspicious activities.
• To monitor subscriber/user activity on the Site, especially for potential professional use, and to audit, inquire into, require reaffirmation of, restrict, limit, or deactivate accounts as deemed necessary for compliance. This may include contacting you to verify compliance with these Terms and applicable law. Please note that creating multiple accounts to access free trials may be considered misuse, and such activity could result in the suspension of accounts and service.

8. Billing Errors, Promotional Prices, and Discounts

Any promotional prices or discounts will be displayed at checkout. If you believe you have been billed incorrectly, please promptly contact our Customer Service department toll-free at 1-866-885-6480 to report the error. We will strive to resolve any discrepancies as quickly as possible.

9. Proprietary Rights

All proprietary rights to the Site’s Content, including PeopleFinder Queries, as well as the design, arrangement, compilation, and coordination of such Content, are owned by or licensed to PeopleFinder.Info and are protected under applicable intellectual property laws (including copyright and trademark laws). Except as explicitly permitted in these Terms or with PeopleFinder.Info’s written consent, you are not granted any rights or licenses to use any patents, copyrights, trade secrets, publicity rights, trademarks, service marks, know-how, or other proprietary rights of PeopleFinder.Info or the Content. The “PeopleFinder.Info” name and logo, along with all custom graphics, icons, and service names, are trademarks of PeopleFinder.Info. All other trademarks remain the property of their respective owners.

PeopleFinder.Info reserves all rights not expressly granted in these Terms. By using the Site, you do not acquire ownership of the Site, our services, Content, or any other information obtained from it.

10. Your Grant of License to Feedback, et al.

We appreciate feedback and suggestions on how to enhance the Site, Content, and PeopleFinder Queries. By submitting any ideas, suggestions, information, or other materials, you represent and warrant that such feedback does not infringe upon, misappropriate, or violate the intellectual property or proprietary rights of any third party, and that you possess all necessary rights to provide this feedback to us.

By submitting feedback, you acknowledge and agree that, subject to the Privacy Policy, you grant PeopleFinder.Info an irrevocable, perpetual, royalty-free, worldwide, transferable, assignable, sublicensable, fully paid-up, non-exclusive right and license to use, copy, display (in whole or in part), adapt, distribute, publish, reproduce, disseminate, transmit, create derivative works from, commercialize, retain, analyze, and otherwise use your feedback globally, in any form, medium, or technology now known or later developed, without any obligation to notify, approve, identify, or compensate you or any other party. By submitting materials, you expressly waive any claim to the contrary.

This license applies to any information, ideas, concepts, comments, feedback, suggestions, Content, Registration Data, and other materials you provide directly or indirectly to PeopleFinder.Info through the Site. This includes information associated with Search Subjects and any ideas or suggestions related to the Site or our services. By providing such materials, you represent and warrant that neither your submission nor PeopleFinder.Info’s use of your submission will violate any agreement, law, or third-party rights (including privacy and intellectual property rights) and that the information you submit is accurate.

PeopleFinder.Info does not solicit ideas, concepts, or other materials for improving the Site or services provided through the Site, and you acknowledge that you bear all risks related to the use or distribution of any such ideas, concepts, or materials.

11. Posting Reviews, Social Media Forums, Rights to Use and Use at Your Own Risk

You acknowledge and agree that you do not have any proprietary interest in the content of the Site or any affiliated platforms we control, including social media pages, blogs, message boards, comment sections, and other interactive features where users may post comments and other content. By submitting any feedback, suggestions, reviews, or forum contributions, you grant PeopleFinder.Info a royalty-free, irrevocable, non-exclusive, assignable, transferable, and sublicensable license to use, reproduce, modify, publish, translate, create derivative works from, distribute, transmit, perform, and display such content (in whole or in part) for any purpose and/or to incorporate it into other works in any form, medium, or technology now known or later developed, for the entire term of any rights that may exist in such content. You represent and warrant that you hold all necessary rights to submit your review or forum contribution to us and to the Site. Furthermore, you agree that these reviews and forum contributions are non-confidential for all purposes, and we have no control over how any third party may use ideas or information therein once posted. We assume no responsibility for and recommend against posting any confidential or sensitive information. You alone are responsible for any liability arising from your reviews and forum contributions.

To post honest reviews and commentary about the Site, PeopleFinder Queries, and related services or items, and/or forum contributions, you acknowledge and agree to the following:

• Only Registered Users: You must be a registered Site user and a subscriber who has previously ordered PeopleFinder Queries.
• Email Address Match: You will provide the email address associated with your Site registration. If your email does not match a registered Site user, your review or forum contribution may not be posted and/or may be removed.
• Genuine and Relevant Content: You will only submit honest and relevant reviews or forum contributions that reflect your personal experience with the Site.

You further agree not to post, display, upload, or transmit any content that:

• Defames, stalks, intimidates, harasses, threatens, or infringes upon the rights of others;
• Interferes with or disrupts the operation of the Site or affiliated platforms;
• Contains unauthorized copyrighted materials or infringes on any intellectual property, privacy, or publicity rights;
• Impersonates another person or entity, including PeopleFinder.Info employees or representatives;
• Encourages criminal conduct, could lead to civil liability, or otherwise violates laws or regulations in any jurisdiction;
• Uses obscene, profane, vulgar, or otherwise objectionable language or images;
• Constitutes junk mail, spam, unauthorized advertising, or promotional materials;
• Misrepresents your affiliation with us or any related entities;
• Includes irrelevant or off-topic statements or material.

PeopleFinder.Info reserves the right, at its sole discretion, to refuse to post or to remove any review or forum contribution without notice. We do not endorse or assume liability for the content uploaded or submitted by users. While we generally do not pre-screen, monitor, or edit user-generated content on forums, chat rooms, message boards, or other interactive services, we and our agents reserve the right to remove content that we believe does not comply with these Terms or is otherwise harmful, objectionable, or inaccurate. We are not responsible for any delay or failure to remove such content. You consent to such removal and waive any claims against us related to this removal of content.

12. Membership Requirements and Conditions

By submitting a complete and accurate online application, agreeing to these Terms, and receiving approval from PeopleFinder.Info, you can obtain an account by paying the applicable fees. Subscribers, subject to these Terms and applicable fees, may access PeopleFinder Queries and other services available to account holders. These provisions apply if you submit an application for an account and, upon approval, become a user/subscriber:

1. Registration
